BlueWhaleSWS – Terms & Conditions
Thank you for considering Blue Whales Soft Wash Systems for your residential window cleaning needs. By choosing our services, we aim to establish fairness and transparency for both you, the reader, and our valued clients. Please take a moment to acquaint yourself with the terms and conditions governing our business:
These Terms & Conditions apply to all exterior cleaning services provided by BlueWhaleSWS (“the Company”, “we”, “us”, “our”). By booking or allowing works to proceed, the Client confirms acceptance of these Terms & Conditions.
1. Definitions
1.1 The Company / We / Us – BlueWhaleSWS Units 10–11 Whittingtons Court, Wheatley Hall Road, Doncaster, DN2 4PE.
1.2 Client / You – The person, company, or organisation requesting or receiving services.
1.3 Services – Exterior cleaning services including but not limited to: window cleaning, gutter cleaning, fascia & soffit cleaning, roof cleaning, softwashing, render cleaning, patio & driveway cleaning, pressure washing, and associated treatments.
1.4 Site / Property – The address where services are carried out.
2. Contract Formation
2.1 These Terms constitute a binding contract between the Company and the Client.
2.2 Any booking made via phone, email, website, quotation acceptance, or commencement of works constitutes acceptance of these Terms.
2.3 No variation to these Terms is valid unless confirmed in writing by a Company Director.
3. Quotations & Pricing
3.1 Quotations are based on visual inspections, customer descriptions, measurements, and/or photographs provided.
3.2 Prices may be revised if:
- Access restrictions differ from those described
- Surface condition is worse than reasonably expected
- Additional treatments or time are required
3.3 Quotations are valid for 30 days unless stated otherwise.
3.4 One-off cleans, periodic cleans, and maintenance plans may be offered at different price points.
4. Expected Results & Limitations
4.1 Exterior cleaning improves appearance but does not restore surfaces to new condition.
4.2 The Company is not responsible for:
- Permanent staining, etching, corrosion, oxidisation, or UV damage
- Moss staining remaining after roof cleaning
- Pre-existing damage revealed during cleaning
- Colour variation after cleaning
4.3 Softwashing and pressure washing may reveal defects previously hidden by dirt, algae, or moss.
5. Access & Site Conditions
5.1 The Client must ensure safe and unrestricted access to all areas to be cleaned.
5.2 The Client must provide:
- Access to water supply
- Electricity if required (where agreed)
5.3 The Company reserves the right to refuse or stop work if unsafe conditions are identified, including fragile roofs, loose tiles, unsafe surfaces, or aggressive behaviour.
6. Weather Conditions
6.1 Exterior cleaning is weather dependent.
6.2 Services may be postponed due to:
- Heavy rain
- High winds
- Frost or freezing temperatures
- Unsafe working conditions
6.3 Weather-related postponements do not constitute cancellation.
7. Scheduling, Cancellations & Missed Appointments
7.1. The Client can cancel the scheduled service by giving no less than 4 day’s prior notice in writing.
7.2. There is a cancellation fee of £300 or full cost of service whichever is lesser if cancelled within 4 days of the booked service.
7.3. The Company reserves the right to retain the 50% deposit as a cancellation fee/part of a cancellation fee.
7.4. The Client must pay the full price of the booked service if:
7.4.1 Our cleaners arrive at the Client’s address and are unable to gain access to the Client’s premises, through no
fault of the Company. If keys are provided they must open all locks without any special efforts or skills;
7.4.2 The Client cancels the booked service with less than 24 hours’ prior notice.
7.5. If the Client needs to change a cleaning day or time, the Company will do its best to accommodate him. Any
changes to booked services are subject to a 4-day prior notice and availability.
8. Payment Terms
8.1 Payment terms will be confirmed at booking.
8.2 Residential maintenance services may be collected via Direct Debit.
8.3 One-off or project work may require a deposit of up to 50%.
8.4 Invoices are payable on receipt unless otherwise agreed.
8.5 Late payments may incur:
- Administration fees
- Interest at 3% per month
- Recovery or legal costs
9. Damage, Breakages & Liability
9.1 The Company holds Public Liability Insurance.
9.2 The Company is not liable for:
- Pre-existing damage
- Fragile surfaces or poorly maintained structures
- Roof tiles, pointing, seals, render, or gutters already defective
9.3 Any damage must be reported within 24 hours of service completion.
9.4 Liability is limited to the cost of rectifying the affected area only.
10. Complaints & Rectification
10.1 Complaints must be reported within 24 hours of completion.
10.2 The Company will be given the opportunity to re-attend and rectify any issues.
10.3 Refunds are not provided where remedial work is offered and accepted.
11. Guarantees
11.1 Where a satisfaction guarantee is offered, it applies only to workmanship and not surface condition.
11.2 Guarantees do not apply where:
- Third parties interfere with treated areas
- Aftercare advice is not followed
- Weather impacts results
12. Health & Safety
12.1 The Client must notify the Company of:
- Fragile roofs
- Asbestos-containing materials
- Hazardous substances
- Underground services
12.2 The Company complies with Health & Safety at Work Act 1974.
13. Data Protection
13.1 Client information is stored securely and processed in accordance with UK GDPR.
14. Force Majeure
14.1 The Company shall not be liable for delays or failure caused by events beyond reasonable control.
15. Governing Law
15.1 These Terms are governed by the laws of England and Wales.
16. Acceptance
16.1 By booking or allowing work to proceed, the Client confirms acceptance of these Terms & Conditions
